TERMS & CONDITIONS
PLEASE READ THESE PROGRAMME RULES CAREFULLY TO FAMILIARISE YOURSELF WITH
THE BASIS UPON WHICH DISCOUNTS AND BENEFITS MAY BE EARNED, UTILISED OR EXPIRED.
1. DEFINITIONS
Unless inconsistent with the context, the expressions set forth below shall bear the following meanings:
1.1 ‘CPA’ means the Consumer Protection Act, 68 of 2008.
1.2 ‘Fraudulent Transaction’ means any transaction which, in terms of the laws of the Republic of South Africa, would constitute fraud.
1.3 ‘Good Standing’ means that you are not in breach of any of your obligations towards us, whatsoever.
1.4 ‘Malas/Our/Us/We’ – means Malas (Pty) Ltd, a private South African company with registration number 1998/007342/07 and with registered address at 37 Visagie Street, C/o Kgosi Mampuru Street, Pretoria, GAUTENG and reference to ‘Malas’ or ‘our’ or ‘us’ or ‘we’ includes all of our affiliates, associates, subsidiaries and respective divisions.
1.5 ‘Malas Help Desk’ means our call centre which can be contacted for any queries or assistance during operating hours.
1.6 ‘Products’ mean those products that Malas offers to its customers and by the purchasing of which Members obtain discounts as determined by the rules contained herein. The Products mainly consist of tyres, wheels, shocks, brakes and batteries which are identified on the Website and may vary from time to time.
1.7 ‘Services’ mean those services as offered by Malas to its customers and by the purchasing of which a Member obtains discounts as determined by the rules contained herein. The Services include wheel alignment, wheel balancing, fitment, tyre rotation, repairs and other related services which are identified on the Website.
1.8 ‘G-Motion Loyalty Account’ means the account that reflects your membership.
1.9 ‘G-Motion Loyalty Discount’ means the discounts that you are eligible for on purchase of Products and/or Services as a Member of the G-Motion Loyalty Programme.
1.10 ‘G-Motion Loyalty Programme’ means our loyalty programme exclusive for Employees of State-Owned Enterprises by means of which Members can get a G-Motion Loyalty Discount and other benefits when purchasing Products and/or Services as set out herein.
1.11 ‘Employees of State-Onwed Enterprise’ means only persons in the employment of State-Owned Enterprises will be eligible for membership in the G-Motion Loyalty Programme, which employment must be proven to qualify for membership.
1.12 ‘Member/s’ means customers of Malas who registered for the G-Motion Loyalty Programme and who was allocated a G-Motion Loyalty membership.
These Terms and Conditions are subject to the provisions of the CPA. In the event of any conflict between the terms hereof and the provisions of the CPA, then the provisions of the CPA shall prevail and any conflicting provision hereof will be severed from these Terms and Conditions and the remainder hereof will remain in force and effect.
2. G-MOTION LOYALTY PROGRAMME
2.1 Membership to the G-Motion Loyalty Programme is strictly for Employees of State-Owned Enterprises only and is subject to you providing authentic proof of employment with State-Owned Enterpsise.
2.2 You consent to receiving communications, marketing materials and related information in respect of the G-Motion Loyalty Programme.
3. G-MOTION LOYALTY DISCOUNT
3.1 Only once you became a Member, you are eligible for G-Motion Loyalty Discount as specified in clause 4.2 every time that you purchase Products and/or Services.
3.2 The G-Motion Loyalty Discount on the Products and/or Services vary depending on brands, applications and product or service types.
3.3 You must seek clarity on the value of the G-Motion Loyalty Discount for the Products and/or Services you intend to purchase.
3.4 The G-Motion Loyalty Discount is applicable only to the G-Motion Loyalty Member personally and is not transferable to another person or entity.
3.5 The G-Motion Loyalty Discount cannot be substituted, exchanged or redeemed for cash or refunds in any other way except by means of purchase of the Products or Services.
3.6 It is the responsibility of the Member to provide their membership number to get the G-Motion Loyalty Discount when purchasing Products and/or Services.
4. G-MOTION LOYALTY BENEFITS
4.1 Once you become a G-Motion Loyalty Member, you will be eligible for discounts and benefits as provided for in clause 4.2.
4.2 You will qualify for the following benefits:
4.2.1 Up to 5% discount on Products
4.2.2 Up to 20% discount on Services
4.2.3 FREE Tyre Inspection
4.2.4 FREE Shock testing
4.2.5 FREE Brakes testing
4.2.6 20% discount voucher for food & beverage as offered at the Malas Superstore.
5. REFUNDS
5.1 Should you lawfully cancel any transaction or return any Products or Services for a refund, your G-Motion Loyalty Discount will be reversed accordingly.
5.2 Such Returns or cancellation of transactions are subject to Malas Trading Terms & Conditions and Refunds Policy.
6. G-MOTION LOYALTY ACCOUNT
6.1 Your G-Motion Loyalty Account provides a detailed breakdown of all your transactions that you have processed with Malas.
6.2 You may contact the Malas Help Desk during its operational hours and request any information regarding your G-Motion Loyalty Account.
7. MEMBERSHIP CANCELLATION
7.1 You may cancel your membership at any stage by contacting the Malas Help Desk.
7.2 Malas in it’s sole discretion reserves the right to revoke a Member from the G-Motion Loyalty Programme. Where the Member is revoked, all benefits will be cancelled and the G-Motion Loyalty Discount will no longer apply.
7.3 Should you:
7.3.1 Engage in a Fraudulent Transaction; or
7.3.2 Breach any of the terms of these terms and conditions; or
7.3.3 Payment default and/or account irregularities; or
7.3.4 Misrepresentation or incorrect personal information; or
7.3.5 No longer be in Good Standing with us,
We will automatically cancel your membership and you will no longer be eligible for G-Motion Loyalty Discount or any of the benefits stated.
8. WEBSITE
Once you are registered as a G-Motion Loyalty Member, you can access your Member account as per the instructions provided.
9. CPA
9.1 The Products and/or Services bought with G-Motion Loyalty Discount will be supplied in the same manner and will be subject to the same terms and conditions as if it were bought by any other form of consideration or acceptable legal tender.
9.2 The Products and/or Services bought with G-Motion Loyalty Discount will also be of the exact same quality as if it were bought by any other form of consideration or acceptable legal tender.
9.3 Malas reserves the right to impose a partial or complete restriction on the availability of any of the Products and/or Services to be bought by G-Motion Loyalty Members but Malas will give you prior written notice of no less than 20 (twenty) days before the limitation thereof.
10. LIABILITY FOR TAXES
You are solely responsible for any taxes that may be payable or may fall due as a result of any G-Motion Loyalty Discount or benefits that you have collected, or may become eligible for, if applicable. You hereby expressly acknowledge and admit that we are not responsible for any loss, damage or costs that you may incur, whatsoever, as a result of you becoming liable for any taxes as a result of your utilisation or participating in the G-Motion Loyalty Programme and/or receipt of any G-Motion Loyalty Discount and benefits.
11. RESERVATION OF MALAS’ RIGHTS
11.1 Malas reserves the right to terminate or cancel the G-Motion Loyalty Programme, or amend or vary the terms thereof at any time and which Malas will duly communicate to you.
11.2 Should any G-Motion Loyalty Discount be incorrectly allocated then we reserve the right to reverse any such incorrect discount.
11.3 The rules as stated herein are subject to Malas Trading Terms and Conditions.
11.4 Malas is not responsible for any loss or damage incurred by a Member in any manner whatsoever as a result of participation in the G-Motion Loyalty Programme.
11.5 Malas decision is final in every situation, including any not covered herein. No correspondence will be entered into, and Malas reserves its rights in all instances.
